Attorney General's Department

Function:

The Attorney-General's Department was one of the original departments established at Federation in 1901. It serves the Attorney-General and the Minister for Justice and Customs and provides policy advice and services to government in the following main areas: law and justice including administrative law, bankruptcy, censorship, constitutional law, copyright, courts and tribunals, human rights, international law, law reform, legal assistance, Indigenous law and justice, legislative drafting, marriage and family law, native title, privacy, freedom of information, legal services to the Commonwealth and criminal law; and national security and counter-terrorism including identity security, law enforcement, security law, counter-terrorism and protective security policy and coordination, and emergency management.

Ministerial responsibilities of the Attorney-General

The Attorney-General is the first law officer of the Commonwealth of Australia. The Attorney-General acts as the main provider of legal advice to the Government and has a wide range of responsibilities, including primary responsibility for Australia's national security arrangements and counter-terrorism framework. Specific ministerial responsibilities include: administrative law, alternative dispute resolution, bankruptcy law, censorship and classification, constitutional law and issues, copyright, courts, tribunals and the judiciary, defamation, discrimination, electronic transactions regulation, emergency management coordination, family law and marriage, foreign incursions and mercenaries, freedom of information, human rights, indigenous law and justice programmes, international child abduction, international law, law reform, legal assistance (including legal aid and pro bono assistance), legal profession and legal services coordination, legislative drafting, national security arrangements and counter-terrorism framework, Native Title, parliamentary privilege, privacy law, protection of critical infrastructure and national information infrastructure, protective security policy and coordination, royal commissions, security coordination, telecommunications interception and surveillance devices.

Airport physical security, anti-money laundering strategy, AUSTRAC, Australian Crime Commission, Australian Customs Service including Coastwatch, Australian Federal Police, Australian Institute of Criminology, Australasian Police Ministers' Council, Conference of Corrective Services Ministers, criminal law, criminology, crime prevention and the National Community Crime Prevention Programme, CrimTrac, cybercrime, drugs strategy, Evidence Act, extradition, federal prisoners, firearms, forensics, fraud policy, identity crime, Inter-Governmental Committee on the Australian Crime Commission, international transfer of prisoners scheme, juvenile diversion program, law enforcement, Ministerial Council on Drugs Strategy, Model Criminal Code, mutual assistance, proceeds of crime, protective security, police and police liaison, remission of fines and witness protection.
